Conditions of Sale
The following Conditions of Sale (“Agreement”) define the relationship between The Mat Finish, LLC (“Mat Sanders” or “we” or “us”) and the buyer (“you” or the “buyer”) of the artwork (“Work”) sold in connection with the website at www.matsanders.com (the “Site”). We may modify these Conditions of Sale as well as any other terms, conditions or information on the Site by posting such changes on the Site. By making an offer to purchase any Work or participating in any sale, you accept and agree to be bound by these Conditions of Sale and any other policies, guidelines, FAQs and requirements that we post elsewhere on Mat Sanders from time to time, including Mat Sanders’s Terms of Use.

The Site
 In order to make a purchase, Mat Sanders may use the services of third parties. We reserve the right to withdraw the Work from the Site at any time without any liability whatsoever for the withdrawal. Unless agreed otherwise in writing between you and us, we are not responsible to the buyer in any way with respect to the exhibition or sale of any Work on the Site.

Buyer’s Responsibility
Subject to fulfillment of all applicable terms and conditions of this Agreement, when the buyer makes a purchase on the Site the buyer shall immediately pay the total amount due, comprised of the total purchase price of the Work and all applicable taxes and service fees. By making a credit card purchase, the buyer irrevocably waives any charge-back rights the buyer may otherwise have under the buyer’s cardholder agreement or otherwise. Payment will not be deemed made until we collect the total amount due in good cleared funds. Any claims regarding purchases must be made directly to Mat Sanders.

Taxes
The buyer is responsible for paying all sales, use, GST, VAT or other taxes or charges imposed by law (e.g., a resale royalty) which may be imposed in connection with the sale of the Work that we are required to collect under applicable law and shall indemnify, defend and hold harmless (including reasonable attorneys’ fees) Mat Sanders from costs associated with any failure to do so. We are required to collect sales tax for any Work delivered in the same State that the Work is currently located in.

Packing and Shipping
We are not responsible for any act or omission of any packer, shipper or common carrier in the packing or shipping of the Work.

CUSTOM ORDERS GENERAL TERMS & CONDITIONS

LEAD TIMES:
While The Mat Finish, LLC strives to deliver within the estimated lead time, the delivery times are estimations only and delays may occur. The Mat Finish, LLC will not accept liability for inaccurate estimations.The Mat Finish, LLC cannot take responsibility for any delays in production or delivery that happen as a result of the Covid-19 pandemic.

DRAWING FOR APPROVAL:
Order lead times begin from the receipt of both a minimum 50% deposit of the total due at the time of order and signed drawing for approval (if required). Drawing provided only after the receipt of a minimum 50%
deposit. Lead time for drawings vary.

SHIPPING & DELIVERY:
Receiving your shipment or delivery at your provided address requires payment in full. For any inside or white-glove delivery, you are responsible for ensuring that all goods have free and easy access to their intended destination. You are responsible for determining if the items will t in adequately sized elevators, through doors, around corners, and in hallways turning into the desired room(s). Ground oor delivery only unless there is an elevator. If there are any steps involved, additional charges will apply.
International / Air Freight Quotes are subject to change and valid for 7 days. If not approved by the client and/or order not ready to ship in that 7-day period, international / air freight costing must be re-quoted. For any destination outside of the USA, the customer is responsible for customs, duties, taxes, and any applicable fees. The Mat Finish, LLC cannot quote client’s customs, duties, taxes, or fees.

CLAIMS:
It is your responsibility to inspect all items upon arrival and in the case of visible damage to the exterior package or to the item, you must sign o on the shipment as “Damaged - Subject to Inspection” and you must notify The Mat Finish, LLC immediately via email, maximum within 48 hours of delivery. All claims must be made within 48 hours of receipt of goods. You must photograph the packaging as well as the damage to the item, while retaining all packaging and product for subsequent inspection. Once goods have left your original delivery address and/or after 48 hours of delivery, The Mat Finish, LLC will not accept responsibility for damages or claims.

STORAGE:
The customer assumes all responsibility for storage until delivery.
